Terms of processing of personal data

Pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/ EC (hereinafter referred to as the “Regulation”).

Scope of personal data processed:

The following personal data will be processed: first and last name, title, date of birth, postal address, e-mail address and telephone contact.

Purpose of processing personal data:

Your personal data will be processed in order to adapt the Site to your preferences and settings so that you are offered content that interests you, which also includes the collection of statistical information and reporting on the use of the Site by users (statistical data includes, for example, information about from which stand the user came to these pages, what links they clicked on and how long they stayed on these sites), recognition that the user returns to the Website (when it is to be possible to adapt the Website and/or its contents to the user's preferences; such personalization may also include profiling) and recording data about visits to the Site and activity on it (not only on the Site, but also on other pages that the user accesses), including tracking visitors across websites (so that relevant and tailored advertising can be shown to users and at the same time allow the administrator to evaluate the effectiveness of advertising on this Site; in doing so, personalization and/or evaluation may Profiling also takes place).

In connection with your use of the Website, you may be sent commercial communications (including communications based on automated processing of personal data, including profiling). Your personal data will be processed in this way on the basis of the consent given by you as the data subject in accordance with the provisions of Article 6 (1) (a) of the Regulation.

Legal basis for the processing of personal data:

The provision of personal data for this purpose is not a legal requirement necessary for the use of the Website. You are not obliged to provide personal data, but without providing them it will not be possible to adapt the Website to your preferences or settings, therefore the Website will also offer you irrelevant content, and the settings of certain functions of the Website will not be saved. Failure to provide consent to the processing of personal data will not lead to fewer advertisements displayed to you by the Website, only ads that are not relevant to you will be shown. You can revoke the consent granted to the processing of your personal data at any time (see the section “Your rights related to the processing of personal data”), but the withdrawal of consent to the processing of personal data will have the same effect as not granting consent (as stated in this paragraph).

Method of processing personal data:

Personal data may be processed both automatically and manually. In connection with the processing of personal data for the purposes mentioned above, you may be subject to a decision based solely on automated processing, including profiling (profiling in accordance with the provisions of Article 4 (4) of the Regulation), on the basis of the consent given by you in accordance with the provisions of Article 22 (2) of the Regulation:Processing of personal data consisting in their use to evaluate certain personal aspects relating to a natural person, in particular to analyse or estimate aspects relating to his/her work performance, economic situation, health status, personal preferences, interests, reliability, behaviour, location or movement.“In profiling, the Administrator uses personal data to tailor the Website and business communications to your preferences and needs based on your previous activities on the Website. Granting consent to profiling is not a legal requirement necessary for the use of the Website, but without consent to profiling it will not be possible to customize the Website to your preferences or settings, therefore the Website will also offer you irrelevant content, some Site Features will not be set and you will be shown irrelevant advertising.

Recipients and processors of personal data:

The recipients of personal data will be those who provide tools to target or improve the quality of our services specified in the annex to this document. Your personal data may be provided by the controller to entities providing sufficient guarantees for the protection of your personal data, which the controller has entrusted with the processing of personal data on the basis of a written contract (i.e. processors).

Processors are the entities listed in the Annex to this document.

Transfer of personal data:

The controller does not intend to transfer personal data to a third country outside the European Union or to an international organization.

The period for which the personal data will be stored:

Your personal data will be stored by the controller until their expiration in the relevant tool that stores them, but for a maximum of 2 years, but always for no longer than the withdrawal of your consent to the processing of personal data.

Your rights related to the processing of personal data:

Right to withdraw consent to the processing of personal data

You have the right to withdraw the consent granted to the processing of your personal data for the purposes mentioned above at any time, as well as the right to withdraw the consent granted to profiling. You can do this by changing the cookie settings here, by signing a written notice sent to the postal address or contact email of the administrator mentioned above. The withdrawal of any of your consent does not affect the processing of personal data prior to its withdrawal.

Right of access to personal data:

You have the right to obtain confirmation from the controller whether or not your personal data is processed by the controller. If your personal data is processed, you also have the right to access it together with the following information about:

  • processing purposes;
  • the categories of personal data concerned;
  • the recipients or categories of recipients to whom personal data have been or will be disclosed;
  • the planned period for which the personal data will be stored or, if this cannot be determined, the criteria used to determine this period;
  • the existence of the right to request rectification or erasure of personal data from the controller, restriction of their processing or the right to object to such processing;
  • the right to lodge a complaint with the supervisory authority;
  • all available information about the source of the personal data;
  • whether automated decision-making, including profiling, takes place about the procedure used, as well as the significance and ▪ anticipated consequences of such processing.

Upon your request, the Controller will provide you with a copy of the processed personal data. For additional copies at the request of the data subject, the controller may charge a reasonable fee based on administrative costs.

Right to repair or supplement

You have the right to have accurate personal data processed only. This includes your right to have the controller correct inaccurate personal data concerning you without undue delay. Taking into account the purposes of processing, you also have the right to supplement incomplete personal data, including by providing an additional statement.

Right to erasure (“right to be forgotten”)

You have the right to have the controller erase personal data concerning you without undue delay if one of the following reasons is given:

  • the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
  • you have withdrawn the consent on the basis of which the data pursuant to Article 6 (1) (a) of the Regulation were processed, and there is no further legal ground for the processing;
  • you have objected to the processing pursuant to Article 21 (2) of the Regulation (see section “Right to object”);
  • personal data have been processed unlawfully;
  • the personal data must be deleted in order to comply with a legal obligation laid down in Union or Member State law to which the controller applies;
  • the personal data have been collected in connection with the provision of information society services pursuant to Article 8 (1). Regulations.

The right to erasure does not apply if an exception is granted under the Regulation or the Act, in particular because the processing of personal data is necessary for:

  • compliance with a legal obligation requiring processing under the law of the European Union or of the Member State to which the controller is subject;
  • for the determination, exercise or defence of legal claims.

Right to restriction of processing
You have the right to have the controller restrict the processing of personal data, in any of the following cases:

  • you deny the accuracy of the processed personal data, the processing will be limited to the time necessary for the controller to verify the accuracy of the personal data;
  • the processing is unlawful and you refuse to delete the personal data and request instead to restrict their use;
  • the controller no longer needs personal data for processing purposes, but you require them for the establishment, exercise or defence of legal claims.

If processing has been restricted, personal data may, with the exception of their storage, be processed only with your consent, or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

Right to object:
You have the right to object at any time to the processing of personal data (concerning you) for the purposes of direct marketing, including profiling.

If you raise such an objection, the personal data will no longer be processed for direct marketing purposes.

Right to data portability:

You have the right to have the controller transfer your personal data processed automatically based on your consent to another controller in a structured, commonly used and machine-readable format. In exercising your right to data portability, you have the right to have the personal data processed transmitted directly by one controller to another, to the extent determined by you, directly by one controller to another, if technically feasible.

How can you exercise your rights?

As a personal data subject, you can exercise your rights arising from the processing of personal data at any time by contacting the controller:

Method of providing information

The controller shall provide the information in writing in documentary form. If you contact the Administrator electronically at his e-mail address, the information will be provided to you electronically, unless you request to provide it in paper form.

Right to lodge a complaint

You have the right to lodge a complaint with the supervisory authority within the meaning of the Regulation, i.e. in particular the Office for Personal Data Protection, with its registered office in Pplk.
